CALIFORNIA PRIVACY NOTICE OVERVIEW:
This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS (“Privacy Notice”) supplements the information contained in BrightTALK’s Privacy Policy (collectively, “we,” “us,” or “our”), as well as any other privacy notices we may provide, and applies solely to visitors, members/subscribers, marketing prospects, and others who reside in the State of California (“Consumers” or “you”). This Privacy Notice does not cover TechTarget’s Priority Engine Client Users, employees, or job applicants.
We have adopted this Privacy Notice to comply with the California Consumer Privacy Act of 2018, as amended, and its implementing regulations (“CCPA”) and other California privacy laws. This Privacy Notice includes any requirements provided in the California Privacy Rights Act (“CPRA”), also known as Proposition 24, which was introduced as a ballot measure and was approved by California voters on November 3, 2020.
Any terms defined in the CCPA, other California privacy laws, or in our Privacy Policy have the same meaning when used in this Privacy Notice.
1. Information We Collect
We collect information that identifies, relates to, describes, and/or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a Consumer or Household (“Personal Information”).
Personal Information does not include: (i) publicly available information or lawfully obtained, truthful information that is a matter of public concern (“Publicly available” means: Information that is lawfully made available from federal, state, or local government records or such information that a business has a reasonable basis to believe is lawfully made available to the general public by the Consumers or from widely distributed media, or by the Consumer; or information made available by a person to whom the Consumer has disclosed the information if the Consumer has not restricted the Information to a specific audience); (ii) de-identified or aggregated Consumer information; and (iii) information excluded from the CCPA’s scope (including: (a) health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data, and (b) Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994).

The CCPA provides Consumers (California residents) with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.
A. Access to Specific Information and Data Portability Rights
You have the right to request that we disclose certain information to you about our collection, use, disclosure, selling, or sharing of your Personal Information over the past 12 months. Once we receive and confirm your verifiable Consumers request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

You have the right to request that we delete any of your Personal Information that we collected from you and retained in our databases, subject to certain exceptions. Once we receive and confirm your verifiable Consumers request, we will delete (and direct our applicable Third Parties, Service Providers, and Contractors to delete) your Personal Information from our records, unless an exception applies.

We may choose in the future to offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects.
E. Other California Rights
California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our websites that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. F. Exercising the Right to Know, Access, Transfer, Correction and Deletion Rights
To exercise the right to know, access, transfer, correct, and/or delete your Personal Information in order to exercise the rights described above, please submit a verifiable Consumers request to us using one of the following options:
Only you or a person acting on your behalf who you authorize (a.k.a. an “Authorized Agent”), may make a verifiable Consumers request related to your Personal Information. We will use reasonable methods to verify your request or that of your Authorized Agent including, for example, comparing the email address you used to register on TechTarget or affiliated third party website.
Providing missing or inaccurate Personal Information on behalf of the individual you are representing may also result in the request being denied, unless that information is promptly corrected by the Authorized Agent.
You may only make a verifiable Consumer request for certain information (required by section 1798.110 and 1798.115 of the CCPA) twice within a 12-month period. The verifiable Consumers request must:
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable Consumers request does not require you to create an account with us. We will only use Personal Information provided in a verifiable Consumers request to verify the requestor’s identity or authority to make the request.
G. Response Timing and Format
We endeavor to respond to a verifiable Consumers request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to the email address associated with that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide may only cover the 12-month period preceding the verifiable Consumers request’s receipt. The response we provide will also explain the reasons why we cannot comply with a request, if applicable. For data portability requests, we will endeavor to select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable Consumers request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
H. Personal Information Sales/Sharing Opt-Out and Opt-In Rights
If you are sixteen (16) years of age or older, you have the right to direct us to not sell or share your Personal Information at any time (the “right to opt-out”). Our business, as a business-to-business (“B2B”) provider, is targeted to business professionals. Therefore, we do not collect, sell or share the Personal Information of Consumers we know are less than sixteen (16) years of age. If we learn that we have inadvertently collected the Personal Information of someone under the age of 16, we will immediately terminate the associated account and delete any data in connection with such registration and the user’s activity.
Consumers who opt-in to Personal Information sales may opt-out of future sales or sharing of their Personal Information at any time.
In order to provide you with our services, it is necessary for us to provide and personalize ads, content, and communications based on your use of websites, including with information regarding your interests and your online interactions. If you request that we “do not sell” your Personal Information, as described in this Privacy Notice for California Residents (and our Privacy Policy), you will not be able to use any services we offer that require the continued use of the your business email address, such as maintaining your member account and providing you access to our free Premium Services. Accordingly, members who utilize the “Do Not Sell or Share My Personal Info” link on our websites will be presented with the option to delete their account with TechTarget and their associated Personal Information. If you make this request, you will still be able to access all the information and content that we offer on our websites to non-members. Further, you may register a new account with our websites at any time using a new corporate email address.

7. Processing Minor’s Personal Information, Consumer’s Precise Geolocation, or Consumers’ Reproductive Healthcare Data
For information on minors, please see section 13 of our privacy policy. TechTarget does not knowingly collect precise geolocation data that is used or intended to be used to locate a consumer within a geographical area that is equal to or less than the area of a circle within a radius of 1,850 feet. TechTarget does not collect personal information regarding a consumers’ reproductive healthcare data.
8. Other Laws and Regulations
TechTarget is not regulated by additional laws, which for purposes of registering as a data broker will include the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), the Health Insurance Portability and Accountability Act (HIPAA), California’s Insurance Information and Privacy Protection Act, or California’s Confidentiality of Medical Information Act.
9. Global Privacy Control
As disclosed in section 3, TechTarget may also sell or share personal information with third parties on our website for marketing and advertising purposes. Individuals may opt-out of the sale or sharing of their personal information if you have a Global Privacy Control (GPC) setting enabled on your browser. In those states where it is required, if you have enabled the Global Privacy Control signal, we will treat this as a request to opt out of sales, sharing, and targeted advertising for device and browser information. Note that we do not associate your browser or device information with your direct identifiers such as name or email. Please visit the GPC website for more information.
